1. Acceptance of Terms and Scope

Welcome to BacInk (hereinafter referred to as "we", "the company" or "BacInk"). These terms of service apply to your access to or use of the BacInk website, member accounts, newsletters, contact forms, technical content, Eink Mode products, as well as any current or future free or paid features, subscription services, support services, and related website functionalities (collectively referred to as "the services").

By accessing the website, registering an account, using Eink Mode, activating a free plan, completing payments, subscribing to paid plans, or otherwise using the services, you indicate that you have read, understood, and agree to be bound by these terms of service. If you do not agree with these terms, please do not use the services.

You should read these terms of service, the plan pages, payment pages, and related policies in their entirety before registering, subscribing, or making any payment. Conditions displayed on payment pages or member centers regarding specific plans, prices, offers, functional limitations, or durations also form part of these terms of service.

1.1 Translation Version

This document may provide translations in other languages. In case of any conflicts, ambiguities, or apparent inconsistencies between the translated version and the Traditional Chinese version, the Traditional Chinese version shall prevail.

1.2 User Eligibility

Users who are not of legal age must use the services and related paid services with the consent of their legal guardians. If a minor registers an account, uses the services, or subscribes to paid services, it will be deemed that they have obtained the consent of their legal guardian, and the legal guardian agrees to abide by these terms of service and is responsible for the user's actions.

If we discover or reasonably suspect that a minor has used the services without obtaining the consent of a legal guardian, we may suspend or terminate their account and related services. If you are using the services on behalf of a company, organization, or other entity, you warrant that you have the authority to agree to these terms of service on behalf of that entity.

2. Service Description

BacInk currently offers or may offer the following services:

  • Website and Multilingual Content: Providing technical articles, product information, tutorials, translated content, and related resources.
  • Account and Membership Features: Providing account registration, login, member pages, plan management, payment status, and related account management features.
  • Eink Mode Products: Providing product services related to electronic paper, web reading modes, content conversion, display optimization, or other BacInk announcement functionalities.
  • Subscription Services: Offering Free, Pro, Ultimate, or other free or paid plans announced on our plan pages.
  • Email Subscription Service: Providing a double opt-in subscription mechanism and multilingual newsletters.
  • Contact and Support: Providing contact forms, customer service, or other user support channels.

We may add, modify, suspend, or discontinue all or part of the services as needed for operations, technology, security, legal, or product strategy reasons. If any adjustments significantly adversely affect the existing interests of paid subscription users, we will provide prior notice through website announcements, member centers, email, or other reasonable means.

3. Accounts, Login, and Security

If you register an account, use Eink Mode, or subscribe to a paid plan, you agree to:

  • provide accurate, complete, and up-to-date registration, payment, and contact information.
  • properly safeguard your login credentials, third-party login accounts, and payment information.
  • not share, rent, sell, transfer, or otherwise provide your account or paid benefits to others unless explicitly allowed on the plan page.
  • promptly notify us if you discover unauthorized use of your account, payment information breaches, or other security incidents.
  • be responsible for all activities that occur under your account unless you have notified us in a timely manner about unauthorized use of your account and that activity was not caused by your fault.

We may offer email/password login, as well as third-party authentication login options such as Google. When you choose to log in via a third party, you are also bound by that third party's terms of service and policies.

4. Permitted Use and Prohibited Conduct

You agree to use the services solely for lawful purposes and to adhere to all applicable laws and regulations. You shall not:

  • use the services for any illegal, fraudulent, infringing, misleading, abusive, threatening, or harassing conduct.
  • violate the intellectual property rights, privacy rights, trade secrets, or other rights of BacInk, other users, or third parties.
  • upload, submit, transmit, or distribute viruses, malware, destructive code, or other harmful content.
  • attempt unauthorized access, probing, scanning, interfering with, or disrupting our systems, networks, security mechanisms, payment processes, or third-party services.
  • circumvent, disable, hack, abuse, or interfere with the use limitations, subscription permissions, authentication, measurement, paywalls, or technical protections of the services.
  • automatically scrape, copy, index, train models, resell, or commercially exploit the content of the services, unless we have granted prior written consent or the related functionalities explicitly allow it.
  • impersonate others, falsely represent relationships with others or organizations, or provide false, misleading, or incomplete information.
  • use the services in violation of export controls, sanctions, tax, consumer protection, data protection, or other applicable laws.

5. User Content and License

When you submit text, files, settings, feedback, or other content (collectively referred to as "User Content") to us through contact forms, feedback, customer service, Eink Mode, or other features, you represent and warrant that you own or have secured all necessary rights to submit and use such content, and that such content does not violate any laws, these terms of service, or third-party rights.

To provide, maintain, protect, improve, and support the services, you grant BacInk a global, non-exclusive, royalty-free, sublicensable license to the necessary extent to store, process, transmit, display, reproduce, and technically modify User Content. This license does not constitute a waiver of your ownership rights in User Content.

Opinions, suggestions, or feedback you provide can be used by us without restriction to improve, develop, or promote the services, and we are not obligated to compensate you for such use.

6. Intellectual Property

This website, the services, Eink Mode, software, interface, design, text, images, trademarks, logos, code, databases, documents, and other content, except for User Content or otherwise specified, are owned by BacInk or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.

Provided that you comply with these terms of service and your subscription status is valid, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to use the services solely for the purposes described in these terms of service and on the plan pages. You shall not copy, modify, adapt, distribute, rent, sell, publicly transmit, reverse engineer, decompile, or create derivative works unless permitted by law or with our prior written consent.

Some of our code or projects may be released under open source licenses. The use of such projects is governed by their respective open source license terms; in case of conflict between an open source license and these terms of service, the open source license shall prevail for that open source project.

7. Privacy and Data Processing

Your use of the services is also subject to our Privacy Policy, which describes how we collect, use, store, share, and protect your personal information. When using Eink Mode, membership features, payment functionalities, or customer service functions, account data, payment status, usage records, device and browser information, service settings, and content you submit may be involved.

If you submit personal data or protected content of third parties through the services, you should ensure you have the legal authority to submit, process, and use such data and comply with applicable personal data protection and privacy laws.

8. Plans, Prices, and Taxes

BacInk currently offers Free, Pro, Ultimate, or other plans. The functionalities, quotas, limitations, prices, billing cycles, trials, promotions, and applicable conditions of each plan shall be as displayed on the plan pages, payment pages, member centers, or other announcements at the time.

Unless otherwise specified, prices displayed for the services are in New Taiwan Dollars (TWD) and include applicable business taxes. If the annual subscription plan offers compared to the monthly payment plan, the content and conditions of the offer shall be as indicated on the payment page or in activity announcements.

Prices for promotions, discounts, or limited-time plans described above shall be based on the prices displayed at the time on the payment page. The applicable subjects, applicable periods, applicable plans, and other relevant conditions for each promotion, discount, or offer shall be based on the content of the activity announcements or payment pages. We reserve the right to determine whether the offer applies to new subscribers, existing subscribers, renewal users, upgrade or downgrade users, or other specific users based on the content of individual activities; unless we expressly indicate otherwise, users may not claim any unexpressed rights to offers.

Unless we expressly state otherwise, promotional or discount prices only apply to qualifying subscription behaviors within the activity period; whether renewals, upgrades, downgrades, plan changes, or other subsequent transactions qualify for the relevant offers shall be based on the content of each activity announcement.

The subscription fees already paid remain fixed during that billing period. We may adjust the basic price of the subscription starting from the next billing cycle and will provide reasonable prior notice to users through member centers, emails (Email), or website announcements before the change takes effect.

The Free plan does not require a subscription or payment; users will automatically apply the Free plan upon completing membership registration. Any proportionally calculated amounts (including upgrade differences, remaining period values) shall be based on the actual payment made by the user for that subscription (i.e., the amount paid after applying the current discount).

9. Subscription, Payment, and Automatic Renewal

Subscriptions commence upon successful payment, with the subscription period for monthly plans being one month and for annual plans being one year. Subscriptions for the services are based on member accounts, and each account may only have one valid paid subscription (single plan) at any given time.

Both monthly and annual plans are processed using credit card recurring billing, with subscription fees charged in advance: monthly plans are charged on the same date every month, and annual plans on the same date each year, deducted from the credit card associated with the user for the next payable fee.

By binding a credit card and activating a paid subscription, you expressly authorize BacInk and our payment service providers to charge the subscription fee from that credit card on each due date, until you terminate the subscription. Users should ensure that the bound credit card is valid and can be charged normally; if it needs to be changed or updated, it can be done at any time in the member center.

You should ensure that your payment information is valid and can be charged normally, and promptly update it if there are any changes, expirations, or issues. You are responsible for all costs incurred while using the services, including subscription fees, taxes, bank charges, and any other amounts that you are required to bear under law or payment service terms.

If we are unable to successfully charge the current subscription fee from the user's bound credit card on the due date, we will notify the user via email and allow a 3-day grace period. During the grace period, we will automatically retry to charge, and users can also update their credit card information at any time to resume charging. If the grace period expires without successful charging, the user's subscription will revert to the Free plan from the end of the grace period.

10. Cancellation, Refunds, Upgrades, and Downgrades

10.1 Canceling Subscriptions

Users can apply to cancel both monthly and annual plans at any time. After cancellation, the paid service for the current period can still be used until the end of that period; the system will not renew charges, and the subscription will revert to the Free plan after expiration.

Paid services can be used normally until the expiration date, and users can withdraw their cancellation request or apply to resubscribe at any time before the expiration date to maintain uninterrupted service. When retracting the cancellation of the same plan, the original plan will resume normal renewal charges, and the automatic deduction settings for the originally bound credit card will remain unchanged; if resubscribing or changing plans before expiration, the system will first retract the original cancellation request and then process the new application according to the upgrade or downgrade rules.

Accounts losing eligibility for the current paid plan due to failed payment charges, grace period expiration, cancellation expiration, or refunds will revert to the Free plan. The Free plan does not require a subscription and has no expiration date.

10.2 No Refund Policy and Exceptions

Subscription fees are non-refundable: subscription fees for the services are charged in advance and are not refundable. Except for the exceptional refund circumstances listed in these terms of service, we do not provide refunds, credit amounts, or any forms of alternative compensation for any of the following situations:

  • you actively cancel and the current unutilized period.
  • you have not actually used, logged in, or have low usage during the current period.
  • the difference or remaining value of the original plan after requesting a downgrade.
  • your account is suspended or terminated due to violations of these terms of service, illegal, abusive, fraudulent, or unauthorized acts.

To treat all users fairly, we do not handle exceptions for the above situations on a case-by-case basis. In the following situations, we reserve the right to approve refunds at our discretion: (1) refunds resulting from system errors or abnormal charges; (2) refunds that must be processed due to laws or requirements from authoritative agencies. Refunds for the aforementioned exceptional circumstances are based on our approval results, and users cannot claim refunds for other situations based on this.

Approved refunds will be returned to the original payment method without any handling fees; if the original payment method cannot complete the refund due to financial or banking restrictions, we will contact users separately to assist with handling. The aforementioned no refund principle does not affect your rights under mandatory laws that cannot be waived in advance.

10.3 Upgrades

Users may upgrade their current plan to a higher tier plan at any time, or change a monthly plan to its corresponding annual plan. Upgrades take immediate effect once we have successfully collected the upgrade fee.

Calculation of upgrade fees: We will charge users the difference between the total fee for the complete new plan and the remaining value of the unused portion of the original plan for the current billing period. The remaining value is calculated based on the amount actually paid by the user for the subscription relative to the number of days remaining in the current period. If the remaining value is sufficient to cover the cost of a complete new plan, we will not charge an upgrade fee.

After the upgrade takes effect, the user's subscription period will restart as a complete new cycle from the moment the upgrade is in effect; the expiration date of the original subscription will not be carried over. From the next billing cycle onwards, we will continue to charge based on the amount corresponding to the new plan. If the upgrade fee cannot be successfully collected, we will maintain the content, rights, and billing settings of the user's original plan, and will not change the original plan due to an incomplete upgrade process.

10.4 Downgrade

When a user applies for a downgrade (including lowering the plan tier or switching between monthly and yearly plans of the same tier), the downgrade will take effect uniformly at the end of the current billing cycle. The original plan can still be used until the expiration date during the current payment period; from the next billing cycle, the system will automatically charge the amount corresponding to the target plan and switch to the benefits of the target plan.

No differential charge will be collected for downgrades, nor will any refunds be issued; the value of the original plan during the remaining period will not be converted to cash, nor to any form of account balance or credit amount.

If a user applies for a plan change again before the downgrade takes effect (including retracting the downgrade, upgrading to a higher plan, or changing to a different target plan), the system will consider the most recent valid application. If the new application is for an upgrade, it will be processed according to the upgrade rules and will take effect immediately after the payment of the upgrade differential is successful; the scheduled downgrade application will be automatically retracted. If the new application is for a downgrade to a different target, the system will replace the original scheduled downgrade with the new target, which will still take effect after the original billing cycle ends.

If the downgrade process or the automatic payment for the next period fails (e.g., due to an invalid credit card), the system will handle it according to the payment method and failure rules; if payment is not completed after the grace period, the account will revert to the Free plan.

When a user downgrades to a lower tier plan due to subscription cancellation, payment failure, plan changes, or other reasons, we will provide services according to the features, capacities, usage limitations, and other rules of the downgraded plan at that time; features, content, settings, storage space, or other benefits that are limited to higher-tier plans may no longer be accessible, usable, or maintained in their original state.

If a user exceeds the features or capacity limits of the downgraded plan at the time of downgrade, we may restrict their ability to add, modify, sync, or use related features until they comply with the downgraded plan’s limitations.

11. Free Plan, Trials, and Promotions

The Free plan requires no payment and may be subject to limitations in features, quotas, usage frequency, storage duration, or other constraints. After you complete membership registration, you may automatically qualify for the Free plan.

We may offer trials, discounts, promotional codes, event prices, or other promotions. The terms, periods, applicable plans, renewal prices, and limitations of promotions are subject to what is displayed in the event announcement or payment pages. Unless explicitly stated otherwise by us, users are not entitled to any unexpressed promotional rights.

12. Newsletter Subscription

12.1 Subscription Process

Our newsletter service may adopt a double opt-in mechanism:

  1. You submit your email address to subscribe.
  2. We send you a confirmation email.
  3. You complete your subscription by clicking the link in the confirmation email.

12.2 Unsubscribe

You can unsubscribe from the newsletter at any time by:

  • Clicking the ‘unsubscribe’ link at the bottom of any newsletter email.
  • Requesting to unsubscribe through our contact form or customer service email.

13. Third-party Services, Payment Services, and External Links

This service may integrate or link to third-party websites, authentication, cloud infrastructure, databases, analytics, email, customer service, payment processing, credit card processing, tax calculation, or other service providers, such as Supabase, Google, NewebPay, and PayPal. These third-party services are governed by their respective terms and policies, and we do not control their service content, availability, data processing methods, or security measures.

Online subscriptions, payments, purchases, sponsorships, or other transaction mechanisms of this service may be processed by third-party payment service providers, including but not limited to NewebPay and PayPal. Domestic payments may be processed by NewebPay; international or cross-border payments may be processed by PayPal. The actual available payment methods, currencies, processing fees, transaction limits, and payment processes shall be governed by the information provided on the payment page and by the third-party payment service providers at that time.

When making a payment or binding a payment method, you may need to agree to and comply with the terms of service, privacy policies, payment rules, risk management, and transaction limitations of these third-party payment service providers. Payment information, credit card verification, transaction authorization, deductions, refunds, declined transactions, foreign currency conversions, cross-border transaction fees, or other payment-related operations may be processed by these third-party payment service providers, issuing banks, or acquiring institutions according to their rules.

We do not store full credit card numbers; however, we may retain transaction records, payment status, subscription status, invoicing or accounting tax information, and handle them according to our privacy policy and applicable laws.

If you are unable to use certain features due to disruptions in third-party services, rejected transactions, risk management, failed identity verification, payment failure, exchange rates, fees, or policy changes, we will assist in a reasonable manner, but do not guarantee that third-party services will be continuous, error-free, or meet your specific needs.

14. Service Availability, Changes, and Maintenance

We will make reasonable commercial efforts to maintain the availability and security of this service but do not guarantee that this service will be uninterrupted, fully error-free, without delays, without data loss, or meet the specific needs, expectations, or purposes of users. System maintenance, updates, capacity limitations, third-party services, network issues, security incidents, force majeure, or other factors may lead to temporary interruptions, limitations, or anomalies in this service.

We may modify, suspend, interrupt, limit, or terminate all or part of the service, functions, plans, or content of the service due to operations, promotional activities, product strategies, maintenance, updates, security considerations, compliance with laws, changes in third-party services, technological constraints, business considerations, or other reasonable reasons. To the extent possible, we will notify users through website announcements, member centers, emails, or other appropriate methods; however, this does not apply to situations caused by emergencies, system failures, security incidents, or other matters beyond our reasonable control.

Unless otherwise provided by law, modifications, suspensions, interruptions, limitations, or terminations of the aforementioned services do not automatically generate obligations for refunds, compensation, damages, or other payments; the handling of related fees will be determined by us on a case-by-case basis.

15. Account Termination and Data Retention

When an account loses eligibility for the paid plan due to cancellation, payment failure, refund termination, or other reasons, it will usually revert to the Free plan; your account and established content may continue to be retained according to Free plan limitations, our data retention policies, and privacy policy.

If the user severely violates these terms of use or relevant laws (e.g., fraud, unauthorized usage, posting illegal content, evading payments, etc.), we may suspend or terminate the account without prior notice and cease providing services for the current paid plan. In such cases, any prepaid subscription fees by the user will be handled according to the refund rules in these terms of use and will not be refunded.

Upon account termination (including voluntary deletion by the user, termination of the account by us according to these terms of use, cleaning of long-unused accounts, etc.), we may delete the associated content, settings, and other data related to that account. If the user still has an unpaid subscription that has not expired at the time of account termination, that subscription will be terminated at the same time as the account, and the handling of related fees will be according to the refund rules in these terms of use; unless otherwise explicitly stated in these terms of use or required by law, the user cannot request a refund for prepaid subscription fees, unused value for the period, credit amounts, or other compensations due to account termination.

If a user has not logged in for over a year and has no ongoing paid subscriptions, we may terminate that account; we will notify the user reasonably in advance through the email provided at registration or other appropriate methods before termination.

You should keep a backup of any content or data that is important to you. Except as required by law, we do not guarantee that all content, settings, or records can be recovered after account termination, plan downgrades, quota overages, or data clearing.

16. Suspension and Termination

If the following situations occur, we may limit, suspend, or terminate your use of this service, account, or paid benefits:

  • You violate these terms of use, privacy policy, payment terms, or other applicable policies.
  • You are involved in unauthorized logins, abuse, fraud, evading payments, unlawful activities, infringement, security risks, or actions that cause damage to this service.
  • We determine it necessary to take action according to laws, regulatory authorities, court orders, third-party service requirements, or security risk assessments.
  • You have not used your account for a long time and have no ongoing paid subscriptions.

You may also stop using this service, unsubscribe, or delete your account on the account settings page. For account deletion and handling of personal data, please also refer to our privacy policy.

17. Disclaimer

To the fullest extent permitted by law, this service is provided on an ‘as-is’ and ‘as-available’ basis. We do not guarantee that this service will meet your specific purposes or expectations, nor do we guarantee that this service will be uninterrupted, timely, secure, error-free, completely accurate, comprehensive, or forever available.

Any technical articles, translations, suggestions, demonstrations, output results, or other content provided on this website or service are for general information or product use reference only and do not constitute legal, financial, medical, or other professional advice. You should independently assess and bear the risks of taking action based on such information.

This disclaimer does not exclude or limit the liability that cannot be excluded or limited under applicable law.

18. Limitation of Liability

To the fullest extent permitted by law, BacInk and its affiliates, directors, employees, contractors, agents, or service providers shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or loss of profits, revenue, data, goodwill, or business opportunities arising from the use or inability to use this service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, BacInk’s total liability for any claims related to this service or these terms of use shall be limited to the amount actually paid by you to BacInk for the paid service that caused the dispute in the twelve months preceding the dispute; if you have not paid any fees, the maximum liability shall be NT$1,000.

The aforementioned limitations do not apply to liabilities that cannot be restricted or excluded under the law, including liabilities arising from willful misconduct or gross negligence, as well as rights that cannot be limited under mandatory consumer protection laws.

19. Indemnity

You agree to indemnify and hold BacInk and its affiliates, directors, employees, agents, and service providers harmless from any third-party claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising from your violation of these terms of use, illegal use of this service, infringement of third-party rights, submission of improper user content, unauthorized use of accounts or payment methods, or any third-party claims arising from your use of this service, to the fullest extent permitted by law.

20. Amendment of Terms

We may amend or update these terms of use from time to time. Significant changes will be communicated to you through website announcements, member centers, emails, or other appropriate methods. Unless otherwise specified in the notification, the updated terms take effect at the time of release.

If you do not agree to the updated terms, you should stop using this service and cancel your paid subscription before the next renewal. Continuing to use this service after the updates takes effect constitutes acceptance of the updated terms.

21. Electronic Notices and Communications

You agree that we may provide general communications, service notifications, payment notifications, renewal notifications, terms change notifications, customer service responses, and other messages related to this service through website announcements, member centers, emails, in-product notifications, or other electronic means. You should keep your account email accurate and accessible.

Messages you send to us through email, customer service systems, member centers, or other online channels may be used for general customer service, technical support, or service-related matters. For matters involving contract termination, claims of rights, or other legally binding matters, we may require users to provide relevant information in writing or by other reasonable means to confirm their intent and identity.

The delivery address and contact information we announce can be found on this website; if there are changes, we will notify users through website announcements or other appropriate methods.

22. Applicable Law and Dispute Resolution

The interpretation, effectiveness, and enforcement of these terms of use shall be governed by the laws of the Republic of China (Taiwan), without regard to principles of conflicts of law. For disputes arising from these terms of use or this service, both parties should first negotiate in good faith to resolve the issue; if negotiation fails, except as otherwise mandated by law, the courts in Taiwan with jurisdiction shall be the court of first instance.

23. Severability, Assignment, and Entire Agreement

If any provision of these terms of use is found to be invalid, illegal, or unenforceable, that provision shall be deemed to be severable to the necessary extent, and the remaining provisions shall continue in full force and effect. You may not assign any rights or obligations under these terms of use to any third party without our prior written consent. We may assign our rights or obligations under these terms of use to affiliates, successors, or assignees, and will notify you reasonably.

These terms of use, privacy policy, payment pages, plan pages, and other referenced policies constitute the complete agreement between you and BacInk regarding this service, superseding any prior or contemporaneous oral or written agreements, communications, and proposals related to this service.
